Terms of Service

These Terms of Service ("Terms") govern your use of AVA, a Chrome browser extension that automates form filling on ABAMatrix. By installing or using AVA, you agree to these Terms. If you do not agree, do not use the extension.

1. Description of Service

AVA is a Chrome extension designed to automate the completion of daily session forms on ABAMatrix, a third-party platform for ABA therapy documentation. AVA uses a built-in clinical database to select antecedents, consequences, and other ABA-relevant data in a clinically coherent manner.

AVA is an independent tool and is not affiliated with, endorsed by, or officially connected to ABAMatrix or its parent company in any way.

2. Subscription Plans and Payments

AVA offers the following plans:

  • Founder License: One-time payment of $99. Lifetime access for early adopters.
  • Monthly Plan: $19/month, billed monthly.
  • Annual Plan: $180/year, billed once per year.

All payments are processed securely through Stripe. By purchasing a plan, you authorize AVA to charge your payment method for the selected amount. All sales are final unless otherwise stated in Section 6.

3. License and Permitted Use

Upon purchase, AVA grants you a personal, non-transferable, non-exclusive license to use the extension for your own professional ABA documentation. You may not:

  • Share, resell, or sublicense your access to other individuals or organizations.
  • Reverse-engineer, decompile, or modify the extension's code.
  • Use AVA for purposes other than ABA therapy documentation on ABAMatrix.

4. Device Limit

Each license allows use on up to 2 active devices simultaneously. If you need to use AVA on a new device, you can manage your active sessions from your account dashboard. Exceeding this limit may result in temporary suspension of access on additional devices.

5. Service Availability and SLA

AVA depends on the structure of ABAMatrix's interface. We cannot guarantee 100% uptime as ABAMatrix may update their platform without notice.

We commit to the following response times:

  • Errors caused by AVA's own code (bugs): We will work to resolve within 24 hours of being reported.
  • Errors caused by changes to ABAMatrix's interface: We will work to resolve within 48 hours of being reported.

In the event of a confirmed service disruption, affected users will receive a 7-day extension on their subscription as compensation. In the case of major structural changes by ABAMatrix that require significant rework, active subscriptions may be temporarily frozen (paused) for the duration of the fix, with no charges during that period.

These commitments are best-effort and do not constitute a legally binding SLA guarantee. AVA is a one-person operation and response times may vary.

6. Refunds

Due to the digital nature of the product:

  • Monthly and Annual plans: No refunds are issued for the current billing period. You may cancel at any time to prevent future charges.
  • Founder License (one-time): No refunds after purchase.

Exceptions may be made at our sole discretion for cases where AVA was completely non-functional at the time of purchase due to an undisclosed known issue. Contact us at avanoreply@yahoo.com to request a review.

7. Privacy and Data

AVA does not collect, store, or transmit any client data, session notes, or personally identifiable information about the patients you serve. See our full Privacy Policy for details.

8. Disclaimer of Warranties

AVA is provided "as is" without warranties of any kind. We do not warrant that the extension will be error-free, uninterrupted, or compatible with all versions of ABAMatrix. The clinical data included in AVA's database is provided as a documentation aid and does not constitute clinical advice or replace professional judgment.

9. Limitation of Liability

To the maximum extent permitted by law, AVA and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the extension, including but not limited to errors in clinical documentation generated by AVA.

10. Termination

We reserve the right to terminate or suspend your access if you violate these Terms. You may cancel your subscription at any time by contacting us. Upon termination, your license to use AVA ends immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify active users by email at least 7 days before significant changes take effect. Continued use of AVA after the effective date constitutes acceptance of the new Terms.
